Terms of Service

1. Acceptance of Terms

By accessing or using ListsGenie.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally authorized to enter into a contract.

3. Service Description

ListsGenie is a SaaS platform that enables users to generate Etsy-compatible product titles, descriptions, and tags using AI (OpenAI API).

4. Subscription Plans and Pricing

We offer four subscription plans:

All plans renew automatically unless cancelled before the renewal date.

5. Credit Usage and Limits

Each subscription includes a set amount of AI usage credits per month.

• If credits are exhausted, the user cannot generate additional content until the subscription is renewed.
• Credits reset at the start of each new billing cycle.

6. Cancellations and Refunds

• If you have used any credits, refunds are not available.
• If you have not used any credits, a refund may be granted within 14 days of purchase, subject to review.
• Refunds, if approved, will be processed within a maximum of 30 days, accounting for potential administrative delays.

7. User Responsibilities

• Users are solely responsible for the content they generate and any products they list on Etsy using ListsGenie.
• You must own the rights to any images or materials you upload.
• AI-generated output (titles, descriptions, tags) is fully owned by the user.

8. Prohibited Uses

You may not use the Service:

• To list or promote items that violate Etsy's terms or applicable intellectual property laws.
• For any activity involving copyright-infringing content or unauthorized sale of protected brands.
• For illegal, misleading, or fraudulent purposes.
• To scrape, harvest, or otherwise collect Etsy content outside of Etsy’s official API or permitted OAuth flows.
• To collect, store, or use Etsy API content for analytics, machine learning, or AI training purposes (including cross-user aggregation).
• To attempt to circumvent Etsy API rate limits, authorization, or access controls.

9. Third-Party Services

The platform integrates with OpenAI, payment processors (e.g., Stripe, Paddle), and support tools. By using the Service, you consent to interactions with such third parties under their respective terms and privacy policies.

10. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited conduct.

11. Limitation of Liability

The Service is provided "as is" and without warranties. GenieX Software OÜ is not liable for indirect, incidental, or consequential damages, including loss of sales or Etsy penalties.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Estonia. Any disputes will be resolved exclusively by the courts located in Tallinn, Estonia.

13. Language

These Terms are in English. Any translated version is for convenience only and not legally binding.

14. Changes to the Terms

We may update these Terms periodically. Continued use of the Service constitutes acceptance of the revised Terms.

15. Etsy API Compliance and AI Use

We integrate with Etsy using the official API and permitted OAuth flows. By connecting your Etsy account, you authorize us to access and process your Etsy data only as necessary to provide the Service to you. We do not use Etsy API content to train, fine-tune, or otherwise improve AI/ML models (ours or third parties’), and we do not aggregate Etsy API content across users for analytics or training.

• Official API only: No scraping or unauthorized collection methods are used.
• Inference only: Third-party AI providers (e.g., OpenAI) are used to generate outputs for your prompts; Etsy inputs are shared only as needed to obtain results and are not authorized for model training.
• Scope minimization: We request only the Etsy API scopes needed to deliver the features you use.
• No resale/sharing: We do not sell or share Etsy API content for cross-context behavioral advertising.

16. Data Deletion and Etsy Disconnect

You may disconnect your Etsy account at any time. Upon disconnect or a verified deletion request, we will delete Etsy OAuth tokens and any cached Etsy API content associated with your account, subject to legal retention obligations. AI-generated suggestions stored in your account are your content; you can delete them at any time.
